A case in point is marijuana legislation in the state of Colorado. Landlords and Home Owners Associations continue to grapple with some tough legal issues and decisions, and no matter what “side of the fence” you are on about the use of marijuana, if you own rental property you might want to take a look at your current tenant agreements.
An article in personalrealestateinvestormag.com by Kimberly Smith entitled “Should you rent to tenant who uses legal marijuana” covers some of the issues surrounding the topic. One interesting point made is: “ You may also want to consider that because there are many ways to “use” marijuana, the wording of use might include the use/preparation/growing/consuming in any form..tenants baking pot brownies, eating pot, edible marijuana, vaporizing marijuana, etc.”
If you own rental property in Colorado, make the commitment to take the time to review your rental contracts and lease agreements. When is doubt about any aspect of contracts/leases, seek professional guidance.
