There are several committee meeting on a variety of estate, tax and elder law planning subjects, including assets protection and trusts; income taxes; managing digital assets; roles of trustees and personal representatives/executors; and related topics. Will include discussions with colleagues on federal tax law changes pending upcoming elections.

The National Defense Authorization Act (2015) and the Disabled Military Child Protection Act
Recent legislation (The National Defense Authorization Act 2015) will allow military members to name a special needs trust as beneficiary. Previously, survivor benefits went directly to the children and in the case of special needs children (children with disabilities) this frequently would mean that a disabled military child would have the financial support of their SSI/Medicaid benefits impacted.

EVENT - February 5, 2014 - Woman lawyers, bankers and certified public accountants gather for a fun evening of networking, sharing information and socializing with Sous Chefs Aaron and Vince from Panzano's Restaurant in Denver. Participants had a ravioli cook-off, making the ravioli, stuffing and sauce all from scratch. Table One won the grand prize, a bottle of red wine for each cook. It was a fun evening for all. And, next time you have dinner at Panzano's - consider the ravioli - the group's recipes just might appear on the menu!

Attorney General Eric Holder announced Saturday that the federal government will now recognize same-sex married couples in six new states: Alaska, Arizona, Idaho, North Carolina, West Virginia, and Wyoming. Last week, the Attorney General made a similar announcement with respect to seven other states: Colorado, Indiana, Nevada, Oklahoma, Utah, Virginia and Wisconsin. Saturday’s announcement adds to that list and brings the total number of states where same-sex couples are recognized by the federal government to 32, plus the District of Columbia.
The Attorney General’s announcement means couples married in these states will now qualify for a range of federal benefits, including those administered by the Social Security Administration and Department of Veterans Affairs.

In August, the Office of Personnel Management (OPM) of the federal government published information about phased retirement for federal employees. More information can be obtained at the website www.opm.gov/retirement and also at the federal register website www.federalregister.gov. The 32 page document is available in pdf formate Federal Resigter 581,582,831 etal. Federal Register/Vo.79,No.153/Friday, August8, 2014/Rules and Regulations. There is also available online the 129 page document of Phased Retirement http://federalregister.gov/a/2014-18681 and on www.FDsys.gov.
As per OPM, "the final rule does not address every administrative detail of the phased retirement process. OPM will be issuing separate guidance to assist agencies and employees with administrative and procedural matter that do not need to be addressed I this rule. Employees many not enter phased retirement or submit applications for phased retirement to OPM until 90 days after publication of this final rule."
As of this writing, the Federal Register designated that date as November 6, 2014.

The meeting was very relevant to clients with topics such as Joint Spousal Trusts, Portability, Estate Planning for Same Sex Couples, Asset Protection and Estate Planning Issues for Mobile Clients.

These are very timely topics for clients moving from one state to another, interested in preserving and protecting assets, or dealing with older in trusts that may need to be updated to be responsive to changes in family circumstances.

This Blog is for everyone and anyone who is interested in legal issues related to tax, estate, and trust planning, business succession and probate matters. The blog will talk about retirement planning; the use of Wills and Trusts in order to avoid family conflicts; the role life insurance plays in estate and financial planning; planning for the unexpected with revocable trusts and powers of attorney; solid business exit strategies; achieving your charitable giving objectives; discussions of marital agreements, both pre- and post-nuptial agreements, cohabitation agreements and similar domestic property and partnership agreements; relocating within the United States and abroad and many other legal subjects that confront all of us. This new web-based practice management system, called Clio, is designed specifically for lawyers to provide a high level of security and privacy for lawyer-client information and communications. What this means for clients is a more secure, effective and efficient way to communicate with Barbara. Messages and documents can be shared via a secure web portal and all information shared will be encrypted. Barbara will have access to all of her client's file information related to the work being done for the client 24/7/365, wherever she may be located, with no delay in retrieving files stored offsite.
